Mercedes-Benz Grand Prix Limited (trading as Mercedes-AMG Petronas Formula One Team) ("MGP", "us" or "we") recognise the importance of protecting your personal data. This notice explains how we collect, store and use your personal data in compliance with applicable data protection law, depending on where you are located.

Unless we inform you otherwise, MGP will be the data controller. This notice (the "Privacy Notice") explains how we collect, store and use your personal data that we may collect from you through your use of our webstore at shop.mercedesamgf1.com and/or shop-int@mercedesamgf1.com (the “Website”), and what rights and options you have in this respect.

The types of personal data we may collect and use

We may collect and process the following personal data about you:

  1. Information provided to us by you. This might include: (i) contact information, including name, email, telephone number and address; (ii) payment details; (iii) location information; (iv) your birthday; (v) your personal description and photograph; (vi) IP address; (vii) your marketing preferences; (viii) your browser or device information; (ix) information about your use of our Website and social media; (x) your communications with us; (xi) your participation in promotions, surveys, prize draws or competitions; (xii) information about your attendance at MGP events; (xiii) information provided through your participation in discussion boards or other social media functions; and (xiv) where you report a problem with our Website or other websites that we control.
  2. Information that we collect or generate. This might include: (i) information relating to your relationship with MGP; (ii) your preferences including searched and viewed products; (iii) purchasing activity; (iv) website usage data; (v) Uniform Resource Locators clickstream to, through and from our Website; and (vi) page interaction information.
  3. Information that we obtain from third parties. This might include: (i) information provided by our customers, suppliers or business partners - particularly where you have asked to receive information from MGP; (ii) information available from public sources; and (iii) insights provided by analytics specialists.

Using your personal data: the legal basis and purposes

Your personal data may be stored and processed by us for the following purposes:

  1. To fulfil your orders we will collect the information provided to us by you in order to take steps to enter into a contract with you and allow you to purchase goods on our Website.
  2. To operate, administer, maintain, improve and protect the security our Website, IT systems and processes and other MGP digital platforms - including for troubleshooting, data analysis, testing, research and statistical purposes. We use the information that we collect or generate because it is in our legitimate interests.
  3. To check credit or debit card detail you provide (to process your payments and prevent fraudulent transactions) in our legitimate interests to seek to prevent fraud.
  4. To provide you with marketing information about other goods, services or events that we may feel interest you or are similar to those that you have already purchased or enquired about. Where you have previously expressed an interest in our products or services (and not opted-out of marketing) we will use the information provided to us by you to send you updates because it is in our legitimate interests to promote our other products and services we think you might be interested in.

Where you have opted in to receive updates on our products and services including offers, promotions and new options, we will process your personal data to provide you with these updates in line with the preferences you have provided and will only use your personal data in this way with your consent.

You can withdraw your consent to marketing at any time by contacting us at dpo@mercedesamgf1.com or, where relevant, by following the unsubscribe link in any marketing communications you receive from us.

  1. To create and gather a profile on our fans to understand what might be of interest to you and how we can tailor our goods, services, communications and opportunities for you and provide you with a better fan experience, as well as operate and maintain an internal database of our fans. We will use information provided to us by you, information that we collect or generate, and information we obtain from third parties. We use this personal data because it is in our legitimate interests to know who are fans are, and to engage with our fans accordingly.
  2. To invite you to take part in promotions, surveys, prize draws and competitions and allow you to participate in interactive features of our service we use the information provided to us by you and any other personal data that forms part of the competition entry (this may differ depending on the competition). We do this under our legitimate interest to run our competition effectively and to award the prizes to the winner, and to make improvements to our services and ways of working.
  3. To notify you about changes to our Website and other MGP digital platforms, including to communicate with you when you contact us either by phone, email, online chatbot, or via WhatsApp, we will collect contact information provided to us by you, because it is in our legitimate interest to make sure we can properly respond to your query.
  4. To comply with legal obligations, such as our accounting  and regulatory obligations.
  • Email marketing (if applicable): Where we have a legal basis, we may send emails about our store, new products, and other updates (see our “Marketing Preferences” section for more information).
  • Text marketing (if applicable): We may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. The website uses webhooks and cookies (with your consent) to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS (see our “Marketing Preferences” section for more information).

Marketing Preferences

We would like to send you information about products and services of ours that we think you might like. We may send you direct marketing communications, product information and promotional offers:

  • If you have consented to receiving such communications from us
  • If we have an existing business relationship with you and can rely on your implied consent
  • If you are from a country where the laws permit us to send you such communications based on our legitimate interests, if you have bought a product or service from us, and have not opted out of receiving communications from us (for example the EEA or UK)
  • If you are from a country where the laws permit us to send you such communications

The marketing communications we send will be in relation to our own products or services, your personal data will not be used for third-party direct marketing unless separate explicit consent has been collected for that or you are from a country where the laws permit such processing.

You will always have full control of your marketing preferences. If you do not wish to continue receiving marketing information from us at any time:

  • You can unsubscribe by using the unsubscribe directions or link included in marketing communication from us; or

Customers located in certain regions, such as the EEA and UK, also have the right to object to their personal data being processed for direct marketing purposes at any time. If you would like to object you can contact us by e-mail at dpo@mercedesamgf1.com

We will process all requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.

WhatsApp Marketing Communications

If you opt in to receive marketing communications from us via WhatsApp, we will collect and process your mobile phone number and your WhatsApp profile information (such as your display name and profile photo, where visible to us) for the purpose of sending you promotional messages, product updates, abandoned cart reminders, order-related marketing, and similar commercial communications. The general terms governing our mobile messaging program (including opt-in mechanics, message frequency, message and data rates, age restrictions, prohibited content, and dispute resolution) are set out in our Terms of Service and apply equally to WhatsApp marketing messages.

Sharing with WhatsApp / Meta. To deliver these messages, we share your phone number and message content with Meta Platforms, Inc. (“Meta”), the providers of the WhatsApp service. Meta acts as an independent controller of this data for its own purposes, including providing, securing, and improving the WhatsApp service. Meta’s processing of your information is governed by the WhatsApp Privacy Policy and, where applicable, the WhatsApp Business Terms of Service. Because we use the WhatsApp Business App, messages are sent from a standard WhatsApp account and are subject to WhatsApp’s consumer-facing terms and message-handling practices.

International transfers. Meta is headquartered in the United States and processes data globally. Where you are located in the European Economic Area, the United Kingdom, or other jurisdictions with cross-border transfer restrictions, your information will be transferred outside your jurisdiction. Meta relies on the EU–US Data Privacy Framework, Standard Contractual Clauses, and other lawful transfer mechanisms for these transfers. Legal basis (EU/UK/EEA residents). We rely on your consent and/or the soft opt-in (GDPR Article 6(1)(a); UK GDPR Article 6(1)(a); ePrivacy Directive Article 13 / PECR Regulation 22) as the legal basis for sending marketing messages via WhatsApp and for sharing your number with Meta for this purpose. You can withdraw your consent at any time (see “Your choices” below); withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Your choices. In addition to the opt-out methods set out in our SMS Terms, you can stop receiving WhatsApp marketing messages at any time by:

  • Replying STOP to any WhatsApp message we send you;
  • Blocking our WhatsApp business account from within the WhatsApp app; or
  • Emailing us at dpo@mercedesamgf1.com with the subject line “WhatsApp Opt-Out”.

Once you opt out, we will stop sending you marketing messages via WhatsApp within the timeframe required by applicable law. We may still send you transactional or service messages (e.g. order confirmations, shipping updates, fraud alerts) where you have a separate relationship with us that justifies them.

Retention. We retain your phone number and WhatsApp opt-in records (including the date, time, source, and wording of the consent you gave) for as long as you remain opted in, and as long as needed to demonstrate compliance with applicable marketing laws.

Your rights. Depending on your jurisdiction, you may have rights to access, rectify, erase, restrict, or port your personal data, and to object to processing. EU/UK residents have rights under the GDPR and UK GDPR; California residents have rights under the CCPA/CPRA; residents of other US states with comprehensive privacy laws (e.g. Colorado, Connecticut, Virginia, Texas, Oregon) have analogous rights. How we may share your personal data

MGP does not sell your personal data. We may from time to time, in accordance with the purposes described above and as permitted by applicable law, disclose your personal data to other parties, including: (a) affiliates of MGP (including our subsidiaries, our ultimate holding companies and their subsidiaries); (b) third party service providers relating to the Website or other MGP digital platforms; (c) commercial and business partners; (d) our webstore partners; (e) third party platforms who facilitate competitions, prize draws, marketing and social media campaigns for us; (f)  prospective or actual third party purchasers as part of a potential or actual sale or transfer of business assets; (g) professional advisers such as law firms and accountancy firms; and (h) courts and regulatory, tax and governmental authorities in the countries where we operate.

Unless you have provided your consent, or we are otherwise permitted to do so under applicable law, we will not disclose personal data to our team partners, team suppliers and/or other advertisers or sponsors for their own purposes - but we may provide them with aggregate non-personal data about our users. We may also use such aggregate information to help advertisers reach specific target audiences.

We require all third parties to respect the security of your personal data. Third parties who receive your personal data from us will process your personal data only in accordance with our instructions and consistent with this Privacy Notice and applicable law. These persons may be permitted to further disclose the personal data to other parties as permitted by applicable law.

International data transfers

The disclosures and processing described above may involve transferring your personal data overseas. If you are dealing with us within the UK, and European Economic Area (the “EEA”) you should be aware that this may include transfers to countries outside the UK and EEA. Some of these recipient countries do not have similar or equivalent data privacy laws. We will ensure that any such transfers are carried out in compliance with applicable law. To keep this Privacy Notice as easy to understand as possible, we haven't set out the specific circumstances when each of these protection measures are used. We will endeavour to only provide links to other sites that are from a trustworthy source. However, once you leave our Website or other sites we control, you should be aware and take note that we have no control over any other website. We cannot, therefore, be responsible for the protection of privacy of any information, that you provide on any other website. Those websites, including, without limitation, those of MGP’s webstore operator, will not be governed by this Privacy Notice. If you use any of the links provided to you from our site, you should read their applicable privacy notice before you submit any personal data to these websites.

Automated decision-making

We do not currently use any processing systems which make decisions and produce legal effects for you, or which may otherwise significantly affect you, based solely on automated processing of your personal data.

Retention of personal data

Subject to applicable law, we retain your personal data for (as the case may be):

  1. As long as it is required for our legitimate interests;
  2. As long as it is required to perform our contractual obligations;
  3. As long as we have your consent; or
  4. Such period as is required or required by law or regulatory obligations which apply to us.

We will delete or anonymise your personal data when it is no longer required.

Your rights

Applicable law may provide you with a number of legal rights in relation your personal data that we process depending on where you are located. These rights may include:

  1. a right to know what personal data we process and a right of access to such personal data;
  2. the right to request any incomplete or inaccurate personal data be corrected;
  3. the right to object to our processing of your personal data, including to object to direct marketing;
  4. the right to request deletion of your personal data and/or otherwise restrict our processing of your personal data in some circumstances;
  5. the right to request we restrict our processing of your personal data;
  6. the right to object to our processing of some or all of your personal data on grounds relating to your particular situation which are based on legitimate interests, at any time (and require such personal data to be deleted). If you object, we shall no longer process your personal data unless we can demonstrate compelling legitimate grounds for such processing which override your interests, rights and freedoms or where it is necessary for the establishment, exercise or defence of legal rights; and
  7. a "data portability" right request that we transfer your personal data to you or to a new service provider in a structured, commonly used and machine-readable format.

Our websites and services are not intended for children

Our websites and our services are meant for adults. We do not knowingly collect personal data from children under 18. If you are a parent or legal guardian and think your child has given us information, you can contact us by using the details set out at the top of this Notice.
